What happened

EMS LINQ, LLC experienced unauthorized access to its systems between September 12, 2023, and May 13, 2024, compromising sensitive and personal information of employees and students of its school district customers, including names, addresses, dates of birth, bank account information, and Social Security numbers.

You are included in this Settlement if you were sent written notification that your personal information was potentially accessed, viewed, and/or obtained as a result of the data security incident which occurred between September 12, 2023, and May 13, 2024.

What you can claim

• Documented Ordinary Losses Reimbursement

  $500 each

  Reimbursement for unreimbursed bank fees, long distance phone charges, cell phone charges (if charged by the minute), data charges (if charged based on data used), postage, and gasoline for local travel purchased between September 12, 2023 and the Claims Deadline. Settlement Class Members must submit a Valid Claim with supporting documentation.

• Documented Extraordinary Losses Reimbursement

  $2,500 each

  Reimbursement for actual, documented, unreimbursed monetary losses that were more likely than not caused by the Data Security Incident, occurred between September 12, 2023 and the Claims Deadline, are not covered by Ordinary Losses categories, and where the claimant made reasonable efforts to seek reimbursement from other sources. Requires substantial and plausible documentation.

• Alternative Cash Payment

  $50 each

  A flat cash payment as an alternative to submitting claims for Documented Ordinary Losses or Documented Extraordinary Losses. Settlement Class Members electing this option are not eligible to claim reimbursement for documented losses but may combine this with credit monitoring.

• Credit Monitoring

  One year of credit monitoring available to Settlement Class Members who select this option on the Claim Form before the Claims Deadline. Can be combined with the Alternative Cash Payment.

• Information Security Improvements

  LINQ agrees to implement or maintain various additional data security measures. Any costs associated with these security measures will be paid by LINQ separate and apart from other settlement benefits.

You are a Settlement Class Member if you were sent written notification that your Personal Information was potentially accessed, viewed, and/or obtained as a result of the Data Security Incident which occurred between September 12, 2023 and May 13, 2024.

How to file

Submit a valid Claim Form online on the settlement website, or download the form and mail it to the Settlement Administrator, or call/email to request a paper copy. You must submit your claim by the deadline to receive benefits. Benefits include up to $500 for documented ordinary losses, up to $2,500 for documented extraordinary losses, $50 alternative cash payment, or one year of credit monitoring.
