Jamarius Davis v. Generations Federal Credit Union Data Breach Settlement

What happened

Generations Federal Credit Union experienced unauthorized access to its email system and files containing personal information including names, addresses, Social Security numbers, financial account numbers, credit card numbers, medical and health insurance information between December 13-15, 2022. GFCU disputes the claims and denies any wrongdoing.

Do you qualify?

Settlement Class Members are persons who reside in the United States and were mailed written notification by GFCU that their personal information was potentially accessed as a result of the data incident occurring between December 13-15, 2022.

What you can claim

• Documented out-of-pocket expense reimbursement

  $500 each

  Reimbursement for documented out-of-pocket expenses incurred as a result of the data breach, including bank fees, long-distance phone charges, mobile phone expenses, data charges, postage costs, and gasoline for local travel. Class members must submit valid claims with supporting documentation.

• Lost time reimbursement

  Reimbursement for up to four hours of time spent dealing with the data breach at a rate of $20.00 per hour. Class members must certify that the time was spent addressing issues arising from the data breach and provide a description of how the time was spent. This reimbursement is combined with out-of-pocket expenses under the same $500 limit.

• Extraordinary loss reimbursement

  $4,500 each

  Reimbursement for documented extraordinary losses, including monetary losses that are actual, documented, and unreimbursed, that most likely were not caused by the data breach, occurred between December 13, 2022 and September 15, 2025, and are not covered by other reimbursement categories. Class members must provide documentation of reasonable efforts to avoid or obtain reimbursement for the loss.

• Credit monitoring and identity theft protection

  Two years of credit monitoring and identity theft protection services from three credit bureaus with at least $1,000,000 in identity theft insurance coverage. Class members must select this option on their claim form before the September 15, 2025 deadline.

• Information security improvements

  GFCU will implement and maintain various information security improvements for two years after final approval of the settlement. GFCU will pay for these security improvements separately and apart from other settlement benefits.

Who is in the class

All individuals who reside in the United States and received written notification from GFCU that their personal information may have been accessed, viewed, or obtained as a result of the data breach that occurred between December 13, 2022 and December 15, 2022.

How to file

Submit a Valid Claim Form online or by mail postmarked no later than September 15, 2025. You will need to document out-of-pocket expenses, lost time, and extraordinary losses to receive reimbursement; alternatively, you can request credit monitoring services without proof.
