Perez v. Blackstone Valley Community Health Care Data Breach Settlement

What happened

A targeted cyberattack on Blackstone Valley Community Health Care, Inc.'s computer systems occurred in November 2023. Private information, including names and Social Security numbers, may have been accessed. The defendant denies wrongdoing, but has agreed to settle the lawsuit to avoid costs and uncertainties of continued litigation.

Do you qualify?

Class members are individuals identified by BVCHC's records whose private information was compromised in the November 2023 data breach. Eligible individuals may have been notified directly by BVCHC.

What you can claim

• Reimbursement for Documented Ordinary Expenses

  $250 each

  Reimbursement for actual, documented out-of-pocket expenses incurred due to the Data Incident, such as fees for credit reports, credit monitoring, ID replacement, or postage to contact banks. Losses must have occurred between November 11, 2023, and June 1, 2026.

• Reimbursement for Documented Extraordinary Expenses

  $2,500 each

  Reimbursement for losses from identity theft or fraud that was probably caused by the Data Incident, for losses not already covered by Out-of-Pocket Expenses. Claimant must have attempted to prevent the loss or recover money through insurance. Losses must have occurred between November 11, 2023, and June 1, 2026.

• Reimbursement for Lost Time

  $80 each

  Compensation for time spent responding to the Data Incident at $20.00 per hour for up to four hours, covering tasks such as changing passwords, investigating suspicious activity, or researching the Data Incident.

Who is in the class

All persons whose PII was potentially compromised in the Data Incident, including all individuals to whom Defendant sent an individual notification letter to regarding the Data Incident.

Submit a valid and timely Claim Form online at the settlement website, or download the form and mail it to the Settlement Administrator. You can also call or email the Settlement Administrator to request a paper copy. The claim deadline is June 1, 2026.
