Behavioral Health Resources Data Breach Settlement

What happened

Behavioral Health Resources suffered a data security incident in November 2024 affecting its computer systems. Certain files containing personal information including names, dates of birth, Social Security numbers, medical information, biometric and/or genetic data, government-issued IDs, and health insurance information were potentially accessed. BHR denies all claims and wrongdoing but agreed to settle to avoid the costs and risks of continuing litigation.

Do you qualify?

Any individual who received notice from Behavioral Health Resources regarding the November 2024 data incident and whose personal information may have been impacted by the breach.

What you can claim

• Medical Data Monitoring

  Three years of CyEx Medical Shield Total monitoring service with $1 million medical identity theft insurance, including monitoring for healthcare insurance ID exposure, Medical Record Number exposure, and unauthorized Health Savings Account spending. All Settlement Class Members are eligible to enroll.

• Documented Out-of-Pocket Loss Reimbursement

  $5,000 each

  Reimbursement of up to $5,000 for actual, documented out-of-pocket losses due to the Data Incident occurring between November 20, 2024, and January 12, 2026, including identity theft losses, credit monitoring fees, ID replacement costs, and postage. Requires proof such as bank statements or receipts.

• Reimbursement for Lost Time

  $125 each

  Compensation for time spent responding to the Data Incident at $25 per hour for up to 5 hours, for a maximum of $125. Covers tasks such as changing passwords, remedying identity theft, investigating suspicious activity, and researching the Data Incident. Requires brief description of time spent.

• Pro Rata Cash Payment

  $100 each

  A one-time cash payment expected to be $100 but may be larger or smaller depending on total claims filed. No proof or explanation required.

Who is in the class

All U.S. residents whose Personal Information was compromised in the data incident disclosed by Behavioral Health Resources on or about November 20, 2024.

How to file

Submit a valid Claim Form by the January 12, 2026 deadline. You can submit online at the settlement website, download and mail the form to the Settlement Administrator, or call/email the Settlement Administrator to request a paper copy.
