What happened
Nationwide allegedly failed to properly advise New Mexico insureds that underinsured motorist (UIM) claims are required by law to be reduced by amounts received from the at-fault driver's insurer. Plaintiff alleges breaches of contract, negligence, unjust enrichment, breach of good faith and fair dealing, and violations of New Mexico's Unfair Trade Practices Act. Defendants deny all allegations and maintain they complied with policy terms and applicable law.
Do you qualify?
New Mexico insureds who either (1) submitted an underinsured motorist coverage claim between October 1, 2010, and March 31, 2022, that was reduced/offset by amounts from the at-fault driver's insurer, or (2) purchased UM/UIM coverage from Nationwide during that period.
How to file
Submit a Claim Form by mail or through the online portal by March 30, 2026. You must demonstrate that you submitted an underinsured motorist coverage claim during the class period that was reduced by the amount received from the at-fault driver's insurer. Those who purchased UM/UIM coverage but did not submit a claim will automatically receive a refund check.
