Owners and residents of condominium units at Port Liberté in Jersey City, New Jersey claimed that operations at the nearby Claremont Terminal industrial facility produced noise, odors, light, air pollution, fires, and explosions that decreased their property values and interfered with their use and enjoyment of their units. The defendants deny all liability but have agreed to establish a settlement fund and undertake remedial measures at their facilities.

Do you qualify?

You may be eligible if you owned or leased a unit at one of nine specific Port Liberté buildings (1 Independence Way, 205-208 Shearwater Court West, 100-102 Shearwater Court East, 15 Freedom Way, or 4 Constellation Place) with windows, doors, balconies, or other open-air access facing Claremont Terminal operations at any point between April 26, 2018 and January 23, 2026.

File a Claim Form by May 26, 2026 to receive a cash payment. Contact the settlement administrator at 877-206-2311 or info@PortLiberteSettlement.com for the claim form and instructions. If you do not file by the deadline, you will not receive any settlement benefits.
