What happened
In December 2023, an unauthorized third party gained access to CellNetix information systems and potentially compromised sensitive personal information including names, Social Security numbers, driver's license numbers, state identification numbers, dates of birth, passport numbers, and health insurance information. Plaintiff Nicole Whitcraft sued CellNetix on behalf of affected individuals to seek compensation for the consequences of the data breach.
Do you qualify?
You qualify if you are an individual residing in the United States whose personal information was potentially impacted by the December 2023 data security incident, including all individuals who received a formal Notice of Data Breach from CellNetix. Excluded are CellNetix directors, officers, affiliates, legal representatives, attorneys, subsidiaries, the assigned judge and their family, court staff, and anyone convicted or who pleaded nolo contendere to initiating or aiding the data security incident.

$5,000 eachReimbursement up to $5,000 for documented losses and fees incurred as a result of the Data Security Incident, with supporting documentation required and expenses must be incurred between December 1, 2023 and the claim submission date.
Lost Time Compensation
$90 eachReimbursement for up to 3 hours of time spent responding to the Data Security Incident at $30 per hour (maximum $90), available only to class members who submitted approved claims for Documented Out-of-Pocket Expenses and supported by attestation.
Alternative Compensation Payment
A pro rata cash payment for class members who do not submit claims for Documented Out-of-Pocket Expenses or Lost Time, or whose claims were not approved, calculated according to the Settlement Agreement and may increase or decrease depending on participation.

How to file
Complete and submit a Claim Form online or mail it postmarked no later than January 26, 2026. For reimbursement of out-of-pocket expenses (up to $5,000), include supporting documentation proving the expense was incurred between December 1, 2023 and the claim date and was fairly traceable to the incident. For lost time compensation (up to $90), include an attestation of reasonable time spent responding to the incident. Alternatively, submit no supporting documents to receive a pro rata alternative compensation payment.
