Kunneman v Devon Energy Royalty Underpayment Settlement

What happened

Devon Energy allegedly underpaid royalties on gas and gas constituents from Oklahoma oil and gas wells it operated from January 1, 2013 through December 31, 2025. Devon denies all allegations of wrongdoing but agreed to settle to avoid the costs and uncertainty of continued litigation.

Do you qualify?

All non-excluded persons or entities who are royalty owners in Oklahoma wells who received royalty payments from Devon for gas and its constituents (such as residue gas, natural gas liquids, helium, nitrogen, or drip condensate) during the period from January 1, 2013 through December 31, 2025.

What the settlement pays

Distribution based on volume of gas produced and extent of post-production deductions made by Devon, less attorneys' fees, litigation expenses, administration costs, notice and distribution costs, and case contribution award

Paid from a $52.5M settlement fund. Individual amounts depend on how many valid claims are filed.

Who is in the class

All non-excluded persons or entities who are royalty owners in Oklahoma wells who received royalty payments from Devon for the Claim Period for the Class Wells operated by Devon. The Class claims relate to royalty payments for gas and its constituents (such as residue gas, natural gas liquids, helium, nitrogen, or drip condensate).

How to file

Class members do not need to file a claim to participate; by taking no action, you will be represented by the Class Representative and will receive your portion of the Net Settlement Fund based on the Allocation Methodology if approved by the Court.
