What happened

Kroger is accused of improperly determining "usual and customary" (U&C) prices for insurance claims by not considering the lower prices it charged under its Rx Savings Club or Health Savings Club when calculating U&C prices. Kroger denies wrongdoing and maintains it correctly reported its retail prices as U&C prices. The court has not decided who is right.
