What happened

Kroger allegedly failed to consider the prices it charged under its Rx Savings Club or Health Savings Club when determining its usual and customary ("U&C") prices submitted to insurance companies for prescription drug claims. Kroger denies any wrongdoing and maintains it correctly reported its retail prices as U&C prices. The court has not decided the merits.

Anyone in the United States or its territories who paid, in whole or in part, for one or more prescription drugs from Kroger using insurance between December 9, 2018 and August 23, 2026.
