Whole Foods Market allegedly mislabeled 365 Organic Hot Cocoa Rich Chocolate Flavor Mix by selling it in large opaque canisters with non-functional empty space (slack-fill), causing California consumers to believe they were purchasing more cocoa powder than they actually received for the price paid. The defendants deny all allegations and claim they did nothing wrong.

DCRB Spac Settlement

Shareholders of Decarbonization Plus Acquisition Corporation (DECARB) who held Class A common stock as of the July 13, 2021 redemption deadline and did not redeem their shares allege they were harmed. The defendants have agreed to settle the claims for $8,800,000 without admitting wrongdoing.

BYU Broadcasting Video Privacy Settlement

Barham v. Dental Group of Amarillo Data Breach Settlement

A targeted cyberattack on Dental Group of Amarillo, LLP's computer systems occurred on October 26, 2023. The attack accessed files containing private information including names, email addresses, dates of birth, phone numbers, Social Security numbers, driver's license numbers, and health information such as provider names, dates of service, X-rays, medical history, and dental insurance information. The defendant denies wrongdoing and the court has not decided the merits.

Bank of Canton Data Breach Settlement

In May 2023, a cybersecurity incident occurred at Fiserv, a financial industry service provider, when a criminal actor exploited a vulnerability in Progress Software Corporation's MOVEit Transfer Software. This breach potentially compromised personally identifiable information of Bank of Canton customers that was in Fiserv's possession. The Bank of Canton is settling claims related to this incident.

The data was collected from patients who used BJC's MyChart patient portal between June 2017 and August 2022.

Neiman Marcus Data Breach Settlement

Neiman Marcus Group LLC detected unauthorized access to its computer network in May 2024, resulting in potential exposure of customers' personal information including names, email addresses, dates of birth, gift card information, partial credit card numbers, and last four digits of Social Security numbers.

Mazda Valve Stem Seal Settlement

Certain 2021-2022 Mazda vehicles equipped with 2.5L turbocharged engines allegedly contained defective valve stem seals that caused excessive oil consumption. Ithaca College Tuition Refund Settlement

Ithaca College switched to remote learning and services in mid-March 2020 during the COVID-19 pandemic. Students allege the college breached its contract by no longer providing in-person and on-campus educational services and access to campus facilities for which they had paid full tuition and fees. Ithaca denies liability and claims students received the contracted-for services.

Herman v. Missouri Fiesta BIPA Biometric Data Settlement

Missouri Fiesta, Inc. and W&M Restaurants, Inc. allegedly violated the Illinois Biometric Information Privacy Act (BIPA) by collecting finger scan data from employees who used their Point-of-Sale System in Illinois without providing written notice, obtaining written consent, or issuing a written biometric policy. MD Now Medical Centers Data Breach Settlement

MD Now Medical Centers, Inc. suffered a data breach discovered on or about May 20, 2024, involving unauthorized access to the company's computer network. The breach resulted in the acquisition of private information including names, dates of birth, addresses, phone numbers, diagnosis information, treatment clinic names, patient discharge information, and prescription information of Settlement Class members.

Gomez Ovando v. Mountaire Farms - Unpaid Wages Settlement

Mountaire Farms Inc. and Mountaire Farms of North Carolina Corp. allegedly failed to pay required wages to non-exempt chicken processing employees at their North Carolina facilities. Venture Logistics Data Breach Settlement

Venture Transportation Partners, LLC experienced a criminal ransomware attack on or around May 13, 2023, in which personally identifiable information of settlement class members may have been accessed by unauthorized third parties. Venture denies any wrongdoing and liability, but has agreed to settle the lawsuit on a class-wide basis.

Recology Data Breach Settlement

On November 2, 2023, Recology experienced a data breach in which unauthorized third parties gained access to files containing personal information of individuals with current or former connections to Recology. The accessed files may have contained names, dates of birth, Social Security numbers, driver's license numbers, and other personal information. Recology admits no wrongdoing in the settlement.

Cobean v. Gastroenterology Associates of Central Florida Data Breach Settlement

On or around April 11, 2024, a cyber incident involving Center for Digestive Health resulted in unauthorized access to personal information of employees and patients of Gastroenterology Associates of Central Florida, including names, addresses, Social Security numbers, financial information, and health-related records. The defendant denies wrongdoing and admits no liability, but agreed to settle to avoid the costs and risks of further litigation.

Ocwen Fee Settlement

Ocwen Loan Servicing, LLC allegedly over-charged borrowers for property valuation expenses, including Broker Price Opinions (BPOs) and Hybrid Valuations, which contained undisclosed mark-ups. Ocwen denies the allegations. The parties agreed to settle to avoid the costs, risks, and delays of continued litigation.

Samsara Dash Camera BIPA Settlement

Samsara allegedly violated the Illinois Biometric Information Privacy Act (BIPA) by collecting and storing settlement class members' biometric data through the Camera ID feature of its dual-facing dashboard cameras without their consent. Samsara denies these allegations and any wrongdoing.

Subaru EyeSight Settlement

Subaru vehicles' EyeSight systems—which include Pre-Collision Braking, Rear Automatic Braking, and Lane Keep Assist features—allegedly had defects or deficiencies. Subaru denies the allegations and maintains the systems function properly and were properly designed and manufactured. The parties settled without the court deciding in favor of either side.

CommerceV3, Inc. Data Breach Settlement

CommerceV3 Inc., which operates an e-commerce platform used by Revival Animal Health to sell pet medication, suffered a cyberattack (the "Data Incident") that potentially compromised customer personal information including names, billing addresses, payment card numbers, CVV codes, and expiration dates. CommerceV3 admits no wrongdoing as part of the settlement.

The Steel Coop Wage Settlement

The defendant restaurants failed to pay tipped workers minimum wage and did not provide proper notice about taking tip credits against wages. The plaintiff, a former server and bartender, alleged she and other workers were owed unpaid wages at the full minimum wage rate. Middleton v. ProSmile Holdings Data Breach Settlement

ProSmile Holdings suffered a targeted cyberattack on or about July 7, 2022, in which certain files containing private information were accessed. The files may have contained names, dates of birth, Social Security numbers, driver's license numbers, financial account numbers, payment card numbers, medical treatment information, and health insurance information. ProSmile denies wrongdoing and the court has not decided the merits.

CVS sold store brand over-the-counter eyedrop products that were subject to a recall after FDA investigators found unsanitary conditions in an Indian manufacturing facility. The plaintiff alleges the products were defective, though CVS denies any wrongdoing and the court has not determined liability. The parties agreed to settle the dispute.

Netgain Technology Data Breach Settlement

Netgain Technology, LLC, an IT and cloud computing service provider for healthcare and accounting companies, experienced a data breach between September 2020 and November 2020. An unauthorized individual accessed Netgain's computer systems and disclosed personally identifiable information and private health information that Netgain stored on behalf of its business clients.

Carle Foundation Hospital FLSA Settlement

Named plaintiff Jacqueline Pierro, a former hourly employee of Carle Foundation Hospital, filed a lawsuit claiming the hospital violated the Fair Labor Standards Act, Illinois Minimum Wage Law, and Illinois Wage Payment and Collection Act by unlawfully rounding clock in and clock out times of hourly employees. The defendant has denied all wrongdoing but agreed to settle the matter.

Hampton v. General Motors LLC - Oklahoma GM Engine Litigation

General Motors sold 2011-2014 Chevrolet and GMC vehicles equipped with LC9 5.3 Liter V8 engines that allegedly contain a defective piston assembly causing excessive engine wear, oil consumption, spark plug fouling, rough idling, and potential engine damage. GM denies any wrongdoing but has agreed to settle the case.

Tampa General Hospital Website Data Privacy Settlement

Tampa General Hospital allegedly violated the Florida Security of Communications Act and other laws by using Metal Pixel and other advertising technology (adtech) on its website and patient portal to track users. The hospital has agreed to suspend this adtech and pay $15 to each eligible class member.
